A. To provide the greatest benefit from these facilities,
the Board of Trustees of State Institutions of Higher Learning enacted
regulations that will be strictly enforced by the University Police
Department. Thorough understanding of these regulations is important,
because violations will result in needless expense and inconvenience
to the student.
Pursuant to the provisions of Section 37-105-1, Mississippi Code
of 1972, the Board of Trustees of State Institutions of Higher Learning
does hereby enact the following traffic rules and regulations for
the control, direction, parking, and general regulation of traffic
and vehicles on the campus and streets of The University of Mississippi
situated in Lafayette County, Mississippi, to wit:
A.1 General
(a) The University of Mississippi assumes no responsibility for
the care and/or protection of any vehicle or its contents at any
time it is operated or parked on the campus.
(b) For the purpose of these regulations, the term "vehicle"
includes all automobiles, trucks, motorcycles, bicycles, golf carts,
and any other vehicles operating on land.
(c) For the purpose of these regulations the "restricted area"
of the campus is defined as any designated parking area for faculty
and staff or assigned decal types.
(d) For the purpose of these regulations, the term "decal"
is used interchangeably with the term "hangtag."
(e) For the purpose of these regulations, the term "visitor"
includes all individuals who are not affiliated with the University
as a student enrolled in classes, staff, faculty, vendor, or any
other person who does not use University facilities (i.e., J.D.
Williams Library or Turner Center Fitness Club members) on a regular
basis.
(f) Penalties/fines are subject to change on an annual basis. (Current
fines can be found on the University Police Department's web site
www.olemiss.edu/depts/u_police.)
(g) All faculty, staff, and students, full- or part-time, operating
motor vehicles on campus must familiarize themselves with the traffic
rules and regulations of the University. Lack of knowledge of the
provisions of these rules and regulations will not be accepted as
a defense for violations. These rules and regulations attempt to
cover all instances of parking and traffic control in specific detail.
However, interpretation of the intent of these rules and regulations
will be the responsibility of University Traffic Parking Services.

A.2 Vehicle Registration
(a) Each faculty, staff, and student, full or part-time, who operates
a motor vehicle (including motorcycle/ motorbike) on University
property, regularly or occasionally, is required to register the
vehicle with Traffic Parking Services of the University Police Department
within 48 hours of the time the vehicle is brought on campus. It
is possible to register a new vehicle with no tag or having a temporary
tag. Failure to comply with this rule could result in vehicle immobilization.
If said vehicle is immobilized, the person responsible for the vehicle
is required to go to the Traffic Parking Services Office and register
the vehicle appropriately. The cost of decals is charged to the
person's bursar account. Tickets received prior to vehicle immobilization
will be charged to the person's bursar account.
(b.1) Faculty and staff who fail to register their vehicle(s) by
August 15 of the current academic year will be assessed a $10 late
fee. If a faculty or staff member purchase a new vehicle after the
August 15 deadline, he/she has 48 hours to register the vehicle
after it has been brought on campus, or he/she could be assessed
a $10 late fee.
(b.2) Any student, full or part-time, who fails to register their
vehicle within 48 hours of the time the vehicle is brought on campus
will be assessed a $10 late fee.
(b.3) Parking and traffic violation records are applicable from
August 15 of the current year to August 15 of the following year.
Failure to renew parking registration at the beginning of the fall
semester will result in continuance of previous year's records.
(c) Any faculty, staff, or student temporarily using another vehicle
must, within 48 hours of the time the vehicle is brought on campus,
register the vehicle with Traffic Parking Services, which will issue
a temporary hangtag, price to be determined by the length of time
it is needed. Failure to comply with this rule could result in vehicle
immobilization [see section A.2(a)].
(d) If a vehicle is sold, traded, wrecked, windshield replaced,
or decal number damaged to the point it is not readable, or decal
types changed, the remaining piece(s) of the current decal should
be carefully scraped off and presented to Traffic Parking Services
for number and verification of expiration. A minimal replacement
cost for a current decal will be assessed.
(e) Decal fees are NONREFUNDABLE.
(f) Any boat or trailer kept on the campus for more than 48 hours
must be registered in the same manner as a vehicle. Failure to comply
could result in immobilization [see section A.2(a)].
(g) Every person who operates a motor vehicle on the campus will
be required to have adequate liability insurance coverage, or the
vehicle cannot be registered.
(h.1) Every person who registers a motor vehicle on the campus must
furnish true and correct information on the vehicle registration
format. Those who fail to comply or intentionally give false information
are subject to a fine of $50, loss of parking privileges, and/or
judicial review. Student decal classification is determined by residence.
(h.2) Students must present their Ole Miss ID card when they come
to UPD to pick-up their decal.
(i) New license plate (tag) information obtained for motor vehicles
already registered with Traffic Parking Services shall be reported
to Traffic Parking Services within 48 hours of the time the vehicle
with the new plate is brought on campus. Penalty: $50.
(j) No faculty or staff person shall register any vehicle and obtain
a decal for any full- or part-time student. Failure to comply with
this rule could result in vehicle immobilization. Penalty: $50.
(k) No person who has registered a vehicle and received a decal
shall affix or permit any other person to affix such decal to any
vehicle other than the vehicle for which the decal was issued. Penalty:
$50.
(l) The person in whose name a vehicle is registered with Traffic
Parking Services shall be held responsible for all parking violations
received by that vehicle.
(m) Students who need special parking accommodations due to mobility
problems may receive a 30-day temporary hangtag from UPD that will
enable them to park in faculty/staff parking areas after first obtaining
an authorization slip from Student Health. If the need for special
parking exceeds 30 days, students should contact a county tax collector
to receive a temporary (less than six months) handicap windshield
placard that will enable them to park in handicap and other parking
spaces on campus. All vehicles must be properly registered for the
current academic year and must exhibit the appropriate decal.
(n) Persons needing handicap permits should acquire them from the
state. All handicap permits shall be state issued. The handicap
permit must be displayed in a manner to assure the expiration date
is visible. Anyone with a handicap permit may park in any legal
parking space on The University of Mississippi campus, including
handicap spaces.
(o) The University reserves the right to remove, impound, or immobilize
illegally parked or abandoned vehicles or bicycles or any vehicle
on campus without a decal, with an unauthorized or altered decal,
with no license plate, or any vehicle or bicycle parked in such
a way as to constitute a hazard to the smooth flow of either pedestrian
or vehicular traffic. The owner shall be responsible for all costs
involved in removing, impounding, immobilizing, and storing of such
vehicles or bicycles. Neither the University nor its representatives
will be liable for any damage that occurs during removal, impoundment,
or immobilization thereof. Once a wrecker service has been dispatched
to campus, the owner shall be responsible for wrecker service fees
regardless of whether the vehicle is towed. Immobilization fee:
$50. UPD personnel are authorized to remove a boot from a vehicle;
all other persons are unauthorized to do so. If an unauthorized
person removes a boot from a vehicle, the person is subject to a
$100 fine. If the boot is damaged, destroyed, or stolen due to its
unauthorized removal, the responsible party will be required to
pay to the UPD the current replacement value of the boot and will
be subject to criminal prosecution and/or judicial review. Tow fee
is to be determined by the wrecker service. Altered/Fraudulent Hang
Tag/Decal Penalty: $50.
(p) A student's decal is not valid until it is permanently and properly
affixed on the outside lower corner of the rear window on the driver's
side of the vehicle. Exceptions include convertibles, vehicles with
rear window that lowers into a tailgate, vehicles with rear windows
covered by louvers, pickup trucks with a camper shell, etc. In such
cases, the decal shall be valid when properly and permanently affixed
on the lower outside corner of the front windshield on the passenger
side. In all cases, the decal must be clearly visible and not obstructed
from view. (Taping to the windshield is not sufficient.) Penalty:
$20.
(q) A student who changes place of residence within the academic
year must obtain and affix an appropriate decal for the new residence
within 48 hours after address has changed. Failure to comply could
result in immobilization.
(r) No vehicle shall display more than one current University of
Mississippi parking decal at any time. Penalty: $20.
(s) Lost or stolen decals should be reported to the Traffic Parking
Services Office within 48 hours. Failure to comply could result
in vehicle immobilization. Replacement cost of decal(s) will be
determined by the Traffic Parking Services Office.
(t) Students who have multiple vehicles must register each vehicle
at full price. See section A.2(d) for exception.
(u) Privatized employees (i.e., Aramark, Barnes & Noble, fraternity
and sorority personnel, etc.) will be issued one special hangtag
at the same price as a faculty/staff decal, which must be paid for
at the time of registration. These employees will be responsible
for any personal parking fines. Failure to pay their fines could
result in vehicle immobilization.
A.3 General Regulations, Penalties on Driving and Parking
(a) The responsibility for finding a legal parking space rests with
the motor vehicle operator. Lack of space or unfamiliarity with
the parking areas is not considered a valid excuse for any parking
violation.
(b.1) The University Circle will be closed to vehicular traffic/parking
on weekdays from 7 a.m. until 5 p.m. except for visitors, vendors,
and handicapped. Faculty, staff and students who park unauthorized
on the Circle during these restricted hours will be in violation
and subject to issuance of a parking ticket for "parking in
restricted area".
Parking in the following areas from 7:30 a.m. until 5 p.m. on weekdays
is restricted to faculty, staff, and visitors. The restricted area
shall include all streets and parking lots within the boundary of
Fraternity Row/All American Drive and University Avenue, Grove Loop
and Student Union Drive, Cross Street and the parking lot on the
east side of Meek, Cross Street and Dormitory Row North, Library
Loop and Dormitory West, and Bishop Hall Parking Lot and Chapel
Lane. Also the parking lots of West Magnolia Lot, Howry, George,
Farley, Lamar, Turner Complex, Alumni House, Power Plant, Natural
Products, National Food Service Management Institute, National Center
for Physical Acoustics, Physical Plant, Student Health, Barnard,
Isom, Somerville, Honors College, Rebel Drive from Powers Hall to
Guess Hall, Scruggs Hall parking east of building, Track & Field
Building lot, west and south parking areas of the Indoor Practice
Facility, any other lots designated by the color-coded maps, and
any other area not herein described but where signs are posted.
(b.2) All other parking violations (i.e., yellow curb, unauthorized
handicap, etc.) are enforced and subject to citation 24 hours a
day, seven days a week.
(c.1) Faculty and staff decals must be properly displayed on the
passenger's side of the front windshield and permanently affixed.
(Taping of decals will not be sufficient.) Penalty: $20.
(c.2) Faculty and staff hangtags must be properly displayed from
the rearview mirror. Penalty: first offense: $15, second offense:
$25, third offense and subsequent offenses: $40.
(c.3) Misuse, fraudulent use, or alteration of a faculty/staff hangtag/decal
(i.e., displayed on an unregistered vehicle or displayed on a student's
car) could result in fine, immobilization, or both. Penalty: $50.
(c.4) Possession and or use of a stolen or lost faculty/staff or
student hangtag or decal will result in the violator's paying reimbursement
cost of the decal/hangtag, a fine of $50, and immobilization fees,
and judicial review.
(c.5) Illegal use or altering of state-issued handicap placard will
result in violator's being fined $100 and/or subject to judicial
review.
(d) All state laws governing movement, operation, and parking of
vehicles shall apply on University property.
(e) Operators of motor vehicles are not to park in excess of times
posted on timed parking areas. Penalty: $5 for the first 30 minutes
and $5 for each subsequent 30 minutes.
(f) Bicyclists shall follow state and local regulations governing
movement and operation of bicycles. Penalty: $10.
(g) Pedestrians in crosswalks shall be given the right-of-way at
all times. Penalty: $50.
(h) Unnecessary noise from vehicles such as horns, mufflers, loud
music, or any other noisemaking device is prohibited at all times.
Penalty: $25.
(i) All accidents involving moving or parked vehicles that occur
on University property shall be reported immediately to the University
Police Department.
(j) Any area on the University campus that has been closed off by
the use of barricades or other traffic control devices either placed
or authorized by the University Police Department shall not be entered
by any vehicle unless so authorized. Penalty: $25.
(k.1) Riding or parking a bicycle on lawns, pedestrian paths, or
sidewalks is prohibited except for access to bicycle racks or authorized
bike parking areas. Penalty $25.
(k.2) Motorcycles/motorbikes are to be parked in a regular parking
place as with regular motorized vehicles and relegated to designated
parking zones restrictions like other regular motorized vehicles.
They are not to be parked in areas designated for bicycles/bicycle
racks; they are also prohibited from being driven or parked on lawns,
pedestrian paths, and sidewalks. Penalty: $25.
(l.1) All students between 7:30 a.m. and 5 p.m. weekdays are required
to park in designated parking areas outside of the restricted area.
Penalty: first offense: $15, second offense: $25, third offense
and subsequent offenses: $45.
(l.2) Faculty/staff shall not park in a residence hall parking area
designated exclusively for students between 7:30 a.m.-5:00 p.m.
weekdays; except Student Housing custodial staff. Penalty: first
offense: $15, second offense: $25, third offense and subsequent
offenses: $45.
(m) Vehicles are not to be parked where curbing is painted yellow,
on campus lawns, in posted no-parking zones, or at places where
sidewalks intersect streets. Penalty: $25.
(n) Motorcycles, motorbikes, or bicycles are not to be parked in
buildings, near doorways, or entrances to buildings. Penalty: $25.
(o) Bicycles, motorcycles/motorbikes/or similar types of cycles
are not to be secured to handrails or parked on handicap ramps.
Failure to comply with this rule could result in impoundment of
said vehicle, fine, or both. Neither the University nor its representatives
will be liable for any damage that occurs during removal or impoundment
thereof. Penalty: $100.
(p) Operating any vehicle, motorcycle, motorbike, or bicycle during
hours of darkness without proper headlights, taillights, and/or
reflectors is forbidden. Penalty: $25.
(q) Every person operating a bicycle shall obey all traffic-control
signs or devices and rules of the road applicable to motor-powered
vehicles under Mississippi state laws and other rules as stated
in these regulations.
(r) All operators of motorcycles, motorbikes, or similar types of
cycles and all passengers of said vehicles as well as all operators
of bicycles are required to wear helmets while the vehicle is in
operation. Penalty: $25.
(s) All operators of any type of motor vehicle or bicycle shall
yield right-of-way to emergency vehicles. Penalty: $50.
(t) Operators of all motor vehicles must have in their possession
a valid operator's license. Penalty: $25.
(u) All operators of any motor vehicles must have a valid, up-to-date
license plate (tag) on vehicle in plain view. Penalty: $25.
(v) Operators of any motor vehicle or bicycle may not follow emergency
vehicles while en route to an emergency. Penalty: $25.
(w) Operators of any motor vehicle or bicycle must come to a complete
stop at all stop signs or stop signals. Penalty: $50.
(x) Operators of any motor vehicle or bicycle must yield to through
traffic. Penalty: $50.
(y) Operators of any motor vehicle or bicycle may not drive or ride
across a fire hose. Penalty: $25.
(z) No unauthorized motor vehicle or bicycle may park in a posted
handicapped parking place or block or obstruct access to such a
parking place. Penalty: $100. Persons, who so block, obstruct, or
park unauthorized in a posted handicapped parking place are also
subject to towing charges.
(aa) Operators of motor vehicles or bicycles may not park or stop
so as to block or obstruct a handicap entrance on a sidewalk, street,
or into any building. Penalty: $100.
(bb) Operators of motor vehicles shall not park in any manner so
as to block or hamper movement to any:
(1) Fireplug, fire hydrant, or fire lane - Penalty: $50.
(2) Dumpster - Penalty: $35.
(3) Traffic Flow - Penalty: $35.
(4) Driveway - Penalty: $25.
(5) Other Vehicle - Penalty: $25.
(6) Crosswalk - Penalty: $50.
(cc) The speed limit is restricted to 18 miles per hour on all streets
unless otherwise posted. Penalty:
(1) up to 10 mph above limit - $25.
(2) 11 mph to 25 mph above limit - $50.
(3) over 25 mph above limit - $100.
(4) reckless/careless driving - $100.
(dd) No operator of any motor vehicle shall operate said vehicle
under the influence of alcohol or drugs. Penalty: prosecution through
Lafayette County Justice Court.
(ee) No persons shall park in posted residential areas-Faculty Row,
Alumni Drive, or University Village any time unless they are residents,
on official business, or visitors of residents. Penalty: first offense:
$15, second offense: $25, third offense and subsequent offenses:
$45.
(ff) No operator of any motor vehicle shall park a vehicle with
the left wheels to the curb unless on a one-way street where flow
of traffic allows vehicle to be faced in that direction. Penalty:
$25.
(gg) The operator of a motor vehicle shall not follow another vehicle
more closely than is reasonable and prudent, having due regard to
the speed of such vehicle and the traffic upon the condition of
the highway. Penalty: $25.
(hh) No operator of any vehicle shall turn such vehicle on the right
side of the roadway unless a traffic lane is provided for such movement.
Penalty: $25.
(ii) No operator shall overtake or pass any other vehicle on the
right side of the roadway unless a traffic lane is provided for
such movement. Penalty: $25.
(jj) No operator of a vehicle shall overtake or pass another vehicle
to the left side of the roadway when a distinctive center line is
marked directing that traffic keep to the right. Penalty: $25.
(kk) No unauthorized vehicles are to be parked in areas or parking
places designated as tow-away zones. Penalty: $50 plus the cost
of the wrecker service. Once a wrecker service has been dispatched
to campus, the owner shall be responsible for wrecker service fees
regardless of whether the vehicle is towed. Tow fee is to be determined
by the wrecker service.
(ll) Operator of any vehicle shall not violate markings, signs,
barriers, or other devices indicating specific lanes or streets
in which traffic shall move in one direction only. Penalty: $50.
(mm) Operator of any motor vehicle or bicycle may not park or stop
so as to park upon or block any sidewalk. Penalty: $25.
(nn) No operator of a motor vehicle may drive in such a manner as
to indicate failure to maintain control of said vehicle. Penalty:
$50.
(oo) No operator shall utilize any traffic lane on a roadway for
any other than its designated use. Penalty: $25.
(pp) University personnel who drive University vehicles are expected
to obey all traffic rules and regulations. Any University vehicle
illegally parked may be cited for the offense and the subject department
held responsible for the traffic fines.
(qq) No person shall park a vehicle within 30 feet upon the approach
to a stop sign. Penalty: $25.
(rr) No faculty, staff, or student may advise a person to park illegally.
Penalty: $25.
(ss) Littering. Penalty: $25.
(tt) Golf carts, utility vehicles, and all-terrain vehicles can
be driven on campus only if they are owned and operated by University
departments. Such vehicles that are privately owned by students,
employees of the University, or visitors are prohibited from use
on campus. Failure to comply with this rule could result in impoundment
of the vehicle, fine, or both. Neither the University nor its representatives
will be liable for any damage that occurs during removal or impoundment
thereof.
(uu) Golf carts, utility vehicles, and all-terrain vehicles are
not to be driven or parked in walkways, on the grass, or on sidewalks.
They should be parked in designated areas. Exceptions will be made
for vehicles that are actively being used in work projects on campus
[to include activities related to commencement exercises].
(vv) Golf carts, utility vehicles, and all-terrain vehicles are
to be operated with headlights and taillights during hours of darkness.
A.4 Hearing Procedure
(a) When any person is accused of violating any of The University
of Mississippi parking/driving regulations:
(a.1) Such persons shall be entitled to a hearing before a Board
of Traffic Appeals for the hearing of such cases. Student cases
are to be heard by the Student Board of Traffic Appeals, members
of which are appointed by the ASB President. Dates, times, and location
for students to appeal are set by the Student Appeals Board and
made available by the Dean of Students Judicial Office (www.olemiss.edu/depts/dos,662-915-7248,
Union Room 401). Faculty/staff cases are to be heard by the Faculty/Staff
Board of Traffic Appeals. The chancellor appoints this board. Dates,
times, and location for faculty/staff appeals are available at UPD's
Parking Services Office (Kinard Hall Wing C, 662-915-7235).
(a.2) Such persons shall further be entitled to receive notice in
writing at least three days prior to the hearing and such notice
shall set forth charges with sufficient particularity and clarity
to enable the accused to prepare a reasonable defense.
(a.3) Such persons shall further be entitled to know the names of
witnesses who are directly responsible for having reported the alleged
violation to the Board of Traffic Appeals; or if there be no such
witnesses, to be fully informed of the manner in which the violation
came to the attention of such board.
(a.4) If a faculty/staff member or student chooses to appeal a ticket,
he/she must submit an appeals form to the respective appeals board.
For student appeals, the appeal form is available online at the
Dean of Students Judicial Office website www.olemiss.edu/depts/dos,
or hand-written forms are available in the Dean of Students Judicial
Office in the Union Room 401 or at UPD's Parking Services Office
in Kinard Hall between 8:00 a.m.-5:00 p.m. weekdays.
For faculty/staff appeals, the appeal form is available at UPD's
Parking Services Office.
Whether submitting the appeal to the student board or the faculty/staff
board, the appeal must be submitted no later than noon of the court
date specified on the ticket. Once the appeal form has been properly
submitted, one can appear in person before the appeals board or
have the appeals board consider only the written/online appeal.
An appeal cannot be made to either board after the court date specified
on the face of the ticket.
(a.5) Such person shall be further entitled to present a defense
to said Board of Traffic Appeals and shall have the right to present
evidence and a reasonable number of defense witnesses and shall
be given the opportunity to hear and question adverse witnesses.
(a.6) Such person shall be further entitled, if the person so chooses,
to be accompanied and represented by legal counsel or by law adviser
provided; however, in all hearings before the Board of Traffic Appeals,
the normal rules of procedure of such board shall be followed; but
in no case shall the board consider any matter not introduced in
evidence at the hearing.
(b) The failure of any person to appear and contest an action upon
delivery of notice in writing of the time and place to appear for
an administrative hearing shall be considered to have waived the
right to such a hearing.
(c) A traffic ticket issued by the University Police Department,
The University of Mississippi, shall be an official University notice
of such administrative hearing.
(d) The findings of the Student Board of Traffic Appeals shall be
final.
(e) The findings of the Faculty/Staff Board of Traffic Appeals shall
be final.
(f) In case of persistent or flagrant violations and in cases involving
the giving of false information, the UPD associate director or captain
of support services may recommend to the proper University official
that disciplinary action be taken against the offender.
(g) The penalty assessed to a student by the Student Appeals Board
is to be paid at the Bursar's Office. Penalties assessed to faculty
and staff by the Faculty/Staff Appeals Board are paid through payroll
deduction.
(h) All discrepancies of bills should be cleared up within the 30-day
period after the first bursar bill has been generated. Failure to
comply could result in charges being due and payable. This will
affect present and former faculty, staff, and students.
II. UNIVERSITY POLICE DEPARTMENT OFFICE
The University Police Department (UPD) is in Kinard Hall in Wing
C. UPD is open 24 hours a day, 7 days a week, year-round. The telephone

UPD's Parking Services Office hours are 8:00 a.m.-5:00 p.m., Monday
through Friday. The telephone number is (662)915-7235; e-mail: parking@olemiss.edu.
All business pertaining to vehicle registration, parking tickets,
and immobilizations must be directed to this office during working
hours.
III. PUBLICATION
The rules and regulations herein promulgated shall become effective
only after notice of the enactment of them has been published in
three consecutive weekly issues of the college newspaper and in
a newspaper published and having general circulation in the county
of municipality where the institution to which the rules and regulations
pertain is located, and such notice shall state where the full text
of such rules and regulation may be found on file. And, in addition,
such rules and regulations shall be posted on five bulletin boards
at such institution for a period of four weeks after their promulgation.
