- Health Law (LAW 704 - Gilchrist) - This Course is a survey of legal issues related to the healthcare industry. Coverage includes all of the major (and some not so major) regulatory schemes in the healthlaw world, such as licensing and certificates of need; patient treatment rights (the Uniform Health Care Decisions Act and law on guardianships and voluntary and involuntary commitments); antitrust issues specific to the healthcare industry; government payor issues (Medicare and Medicaid); HIPAA (Health Insurance Portability and Accountability Act of 1996); Fraud and Abuse law (Anti-Kickback, STARK and the False Claims Act); ERISA, and EMTALA.
- Health Law (LAW 705 - Gilchrist) - This seminar course explores current issues facing healthcare lawyers as they serve the interests of hospital and physician clients in an ever-more-regulated healthcare world. We will look at regulatory bodies in the hospital and physician world, quality of care issues, various healthcare entity structures and contracting issues between hospitals and doctors, medical staff credentialing and other medical staff issues, peer review processes and the concerns that arise from that process. Coverage also includes the fraud and abuse laws, the operation of our Medicare and Medicaid systems, and a brief overview of some current socio-ethical issues facing the healthcare world and our government.
