ABSTRACT

Police, Beware: An Overview of the Fourth Amendment and the Controversies Surrounding Its Exclusionary Rule


This study examines the controversial issues surrounding the Fourth Amendment and the exclusionary rule which was later extrapolated into case law by the federal judiciary. The previous work of two researchers- one for the exclusionary rule and one against the exclusionary rule was compared for the express purpose of determining whether or not the exclusionary rule should be barred from future criminal trials. A historical approach, including the apparent intent of the original Constitutional framers was presented as well as describing the original establishment of the exclusionary rule in case law. The standard factors used to determine the application of the exclusionary rule will be covered, as well as the exceptions to the exclusionary rule in contemporary practice.
